Even if I do not include legal studies in my best of four, will marks still be deducted? Can I include Legal for a BA History course?

I am in class 12, and I did not known that legal studies is not an elective subject when I took it up in 11th. I wish to do a BA Honours course from DU, will I be able to add legal studies in best of four? Even if I don't add, will marks still be deducted?
