Dear Student, Alternative Dispute Resolution (ADR) includes dispute resolution processes and techniques that act as a means for disagreeing parties to come to an agreement as an alternative to court litigation and trial. Common alternatives include mediation, where a mediator helps people come to an agreement, or arbitration, where an arbitrator decides the outcome of the dispute. Many people prefer ADR because it can save people money, time, and aggravation, and can produce better results than trial. For example, as a mediator or arbitrator, I typically help resolve a case in one day, whereas when I was a trial attorney, a typical case took more than a year. There are different approaches that can be taken ranging from a transformative approach focused on helping the people to change their relationship so that it is less conflicted to evaluative mediation on the other extreme where the mediator provides suggestions for what they think should happen and advises about the potential orders a court might make if they cant sort it out themselves. In the middle is the facilitate approach where the mediator focuses on facilitating a fair process and empowering the people to make their own informed decisions for a resolution. LL.
