It is not fixed. You need to clear English proficiency test for visa purposes. Apply in two or three institutes which you feel good. Also there are universities in India which offer credit transfer course which mean that half of the degree a student has to complete i India and half in abroad university like in Lovely Professional University, VIT Vellor etc.

I would recommend you not to drop yours year as it is still not sure that you will able to get top scores in next year JEE or not. I suggest you to join some university and side by side prepare for your JEE, also the first year subjects will cover most of the syllabus of JEE which will help you crack JEE. I have seen many students doing this. This is the safest way.
Check admission on the basis of your twelfth exam or either you can give entrance exam of universities at present. Check for admission in
1. Lovely _Professional University, Punjab
2. Birla Institute of Technology and Science, Pilani
3. KIIT University
